Scope of the conditions
These General Terms and Conditions (GTC) apply to all contracts concluded with Pension Alte Leimsiederei (hereinafter referred to as Pension - guesthouse), provided that they fulfill the characteristics of the GTC Act. They may be replaced by negotiated conditions in individual cases.

Accommodation contract
Through the booking of a room, or its provision at short notice, that is by telephone, the accommodation contract is considered binding. The guesthouse is free to confirm the room booking in writing.

The contracting parties are the guesthouse and the guest. If a third party has placed an order for the guest, he/she shall be liable to the guesthouse together with the guest as joint full debtors for all obligations arising from the accommodation contract, provided that the guesthouse has received a corresponding declaration from the third party.

The guest is obliged to fill in the registration form on arrival. If the guest has reserved accommodation for several days and does not arrive on the scheduled day, the guesthouse assumes that the guest has withdrawn from the confirmed trip if he/she has neither given notice of a later arrival nor arrived by 6.00 p.m. at the latest on the day of arrival.

With the contract, we undertake to keep the rooms booked by the guest ready and to provide the agreed services. If the guesthouse has reasonable grounds to believe that the guest threatens to jeopardize the smooth running of the business or the safety of the house, as well as in the event of a catastrophe (e.g. fire, environmental disaster, etc.); and if other circumstances occur for which the guesthouse is not responsible and which make it impossible to fulfill the contract, the guesthouse may cancel any reservation without being obliged to pay compensation. Furthermore, the guesthouse is entitled to withdraw from the contract extraordinarily if the purpose of the stay is unlawful.

Cancellation
If the guest cancels the rented room in good time, the guest will not incur any costs. This includes verbal as well as all written bookings that are cancelled at least 14 days in advance. If the guest cancels his confirmed booking (he has not objected to our booking confirmation) 13 - 6 days before arrival, the landlord is entitled to 30%, 5-3 days before arrival 50%, of the accrued accommodation costs. If the landlord receives the cancellation within the last 2 days and the room cannot be rented to another party, the landlord is entitled to 90% of the accommodation costs. In the event of cancellation of the booking, the guest is obliged to pay the cancellation fees.

If the requested advance payment is not made by the agreed date, the guesthouse is also entitled to withdraw from the contract.

Dutiful care by the guest
The pension regulations are included in the above contract and are binding for all guests. In the event of gross violations of the pension rules, extraordinary termination is possible. The guest has a special duty of care towards all furnishings of the guesthouse and must ensure that they are treated with care within the framework of the accommodation provided. In the event of use of the room contrary to the terms of the contract, the guesthouse shall have an extraordinary right of termination. In principle, the guesthouse guest may not receive visitors in his/her room. It is also not permitted for persons other than those registered with the hotel to stay overnight. Parties and celebrations are generally prohibited. The guest is liable for any damage caused by him to the hotel inventory. Smoking is prohibited in the entire guesthouse. Failure to comply with this regulation will result in a penalty of 50 euros. In the room, out of consideration for fire protection, the use of heating blankets, irons and other similar electrical appliances that the room furnishings do not offer is prohibited.

Notification of defects
Defects in technical or other facilities provided will, as far as possible, be remedied immediately. However, payments may not be withheld or reduced. Offsetting with counterclaims is excluded. Insofar as the guest notices defects, in particular in the area of the booked room, these must be reported immediately so that the guesthouse staff have the opportunity to rectify reported defects at short notice. A defect that is not reported until departure does not lead to a reduction of the room rate if this defect was not made known to the guesthouse owner.

Payment and prices
The guesthouse owner is entitled to cash payment for all services on arrival and accordingly has a legal right of lien on the guest's belongings brought into the guesthouse. An advance payment may be required. Brochure or internet liability is excluded. The prices can be changed by us if the guest subsequently, but before the start of the journey, requests a change in the number of rooms booked, the service or the length of stay and we agree to this. In the event of an early departure (for whatever reason), the full amount will be due. Unused services from flat-rate, blanket arrangements will not be refunded. The agreed prices include the taxes and duties applicable at the time of conclusion of the contract. Not included are local taxes that are owed by the guest according to the respective local law, such as a visitor's tax or an accommodation tax. In the event of a change in the statutory value-added tax, the prices shall be adjusted accordingly. Our current price list applies. Children under the age of ten can stay with us free of charge, as long as they do not have their own bed. All room prices are for overnight stays only and include bed linen, towels and final cleaning.


Arrival
The rooms can be occupied from 2 pm on. However, an earlier arrival is no problem. You can store your luggage and park your car with us. Should the room already be ready for occupancy, you can of course move into it earlier. In this case, please contact us in advance by telephone. We kindly ask you to arrive on the day of arrival by 6 pm at the latest. Should there be any delays, please inform us in good time by telephone. In order to minimize damage, we reserve the right to release the room for further reservations from the following day if the guest has neither reported nor arrived by then. The day of arrival and departure count as one day for the reservation, so the number of nights are what counts.

Parking spaces
We will provide you with parking spaces as far as available. However, there is no entitlement. The parking spaces must be used in such a way that other vehicles are not obstructed or damaged.

Departure
On the day of departure, the rooms must be vacated by 10 am and the keys handed over to us. It is possible to store the luggage with us free of charge until the evening and to load it at the time of actual departure. If the guest does not ensure that the room is available at this time by vacating it and settling the bill, the guesthouse owner can demand the full price for a further day.

Jurisdiction and liability
The guesthouse is not liable for loss or damage of any kind to items brought in. The exclusive place of jurisdiction is the place of business. German law shall apply. The liability shall be governed by §§ 701-703 of the BGB (Federal Law Book). Liability for other reasons is excluded, unless damage was caused by gross negligence on the part of the guesthouse.

Clause of severability
Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions of this contract. The parties undertake to replace invalid provisions with new provisions which do justice to the provisions contained in the invalid provisions in a legally permissible manner. The same applies to loopholes in the contract. In order to remedy the loophole, the parties undertake to work towards a manner that comes closest to what the parties would have determined according to the meaning and purpose of the contract if the point had been considered by them.
